
A parenting plan is essentially a roadmap directing how children will be raised after separation or divorce. As a co-parenting solution, it is a written agreement drafted by both parents with the help of a neutral third party.
The concept of a parenting plan is arguably one of the most useful legal instruments introduced by the Children’s Act 38 of 2005, purposely designed to lead parents through the emotionally charged messy breakup. Such a plan assists with rights and responsibilities, especially in the critical first 18 months after separation when egos are triggered, and communication may well have deteriorated to a point of complete standstill.
Drafting and agreeing on a parenting plan together as a couple post divorce, created in the best interests of the children, where the couple has mutual interest, is a great step towards opening up communication and collaboration to better manage the conflict.
